• BerryFORMS reserves the right, at any time and in BerryFORMS’  discretion, to temporarily suspend or disable a Subscriber or End User’s access to any ESurvey Services for any reason without incurring liability of any kind.  Causes for such suspension or disablement may include, but are not limited to, repairs, technical problems, outages, maintenance services, or the suspicion or detection of any malicious code, virus or other harmful code or device in the Subscriber or End User’s use of the ESurvey Services.  If, in BerryFORM’s reasonable determination, the suspension may be indefinite and/or BerryFORMS  has elected to terminate the Subscriber or End User’s access or account to the ESurvey Services, BerryFORMS  will notify Users and will work in good faith to determine the appropriate credit, if any, to the Subscriber and/or End User for such suspension or termination.
• BerryFORMS  will ensure the ESurvey Services are available to any Users for which Resellers sells the ESurvey Services in any month, provided that Reseller acknowledges that certain limitations in the ESurvey Services may arise due to connectivity of ESurvey Services with Third Party Service Providers in any calendar month and that BerryFORMS  will have no liability to any Subscriber or End User for any disruptions, limitations or unavailability in the ESurvey Services as a result of such the above mentioned or other limitations in the availability of the ESurvey Services.
• BerryFORMS  may, in its discretion, and without incurring any liability of any kind, (a) discontinue the sale of any ESurvey Services, or (b) discontinue or change the features or functionality of the ESurvey Services at any time.  BerryFORMS  has no obligation to provide USers  with  advance notice of any changes in the ESurvey Services, but may do so in its discretion.
